07
To the fullest extent permissible under Kenyan law, MySpace Africa Ltd shall not be liable for any indirect, punitive, or consequential damages. The Company's total aggregate liability is capped at the fees paid by the Client in the preceding three (3) calendar months.
08
We reserve the right to suspend or terminate access immediately without notice if a material breach of these Terms, non-payment, or a cybersecurity incident occurs. Upon termination, Client data remains available for export for thirty (30) days prior to permanent secure deletion.
09
These Terms are governed by the Laws of the Republic of Kenya. Unresolved disputes shall be submitted to binding arbitration in Nairobi, Kenya, under the Arbitration Act (Cap 49). The arbitral award shall be final and enforceable in any court of competent jurisdiction.
